Terms and Conditions of Sale

These Terms and Conditions of Sale ("TOS") govern the purchase of digital credits ("tokens") allowing the use of advanced features of the Sailboatlab service, including AI-assisted search.

By purchasing tokens or using the service, the user fully accepts these Terms without reservation.

Sailboatlab is an online platform providing sailboat search, comparison and analysis using algorithms, technical databases, and artificial intelligence systems.

Certain features require the use of digital tokens.

Tokens allow access to computing resources whose cost depends on the complexity of processing.

Tokens are internal virtual units.

They do not constitute:

• electronic money
• financial instruments
• property rights
• refundable assets
• legal tender

3. SALE OF TOKENS

Tokens are sold in packs.

Standard pack: 100 tokens

Prices are displayed on the website at the time of purchase.

Tokens are credited after payment confirmation.

Tokens are consumed automatically when using paid features.

Tokens:

• are personal
• are non-transferable
• are non-refundable
• cannot be exchanged for money
• cannot be resold
• cannot be converted

The Seller may modify at any time:

• pricing
• token consumption rules
• token costs per operation

without retroactive effect.

4. NO RIGHT OF WITHDRAWAL

In accordance with applicable consumer laws, the right of withdrawal does not apply to digital content supplied immediately.

By purchasing tokens, the user:

• requests immediate execution of the service
• expressly waives any withdrawal right

Tokens are non-refundable, in whole or in part.

No refund will be issued in case of:

• unused tokens
• user error
• dissatisfaction
• incorrect results
• service interruption
• account closure

5. NATURE OF THE SERVICE – NO WARRANTY

The service provides results generated from:

• databases
• algorithms
• automated processing
• external sources
• artificial intelligence systems

The Seller does not guarantee:

• accuracy
• completeness
• relevance
• availability of listings
• correctness of data
• absence of errors
• absence of AI hallucinations
• continuous updates

Results are provided for informational purposes only.

They do not constitute:

• professional advice
• technical expertise
• purchase recommendation
• valuation
• certified analysis

The user remains solely responsible for decisions.

6. ARTIFICIAL INTELLIGENCE

Some features rely on artificial intelligence systems.

Such systems may produce:

• incorrect results
• approximations
• inconsistencies
• incomplete data
• unexpected outputs

The Seller does not guarantee reliability of AI responses.

The user acknowledges that AI systems may produce inaccurate results.

Tokens used for a request are never refunded.

7. LIMITATION OF LIABILITY

The service is provided "AS IS" and "AS AVAILABLE".

The Seller shall not be liable for:

• financial losses
• loss of opportunity
• loss of data
• purchase decisions
• investment decisions
• incorrect analysis
• service downtime
• server failure
• software bugs
• network issues
• AI errors
• database errors
• third-party data errors
• listing removal
• API failure
• external provider failure

The Seller does not guarantee:

• uninterrupted access
• error-free operation
• compatibility with all devices
• minimum performance

Total liability of the Seller is limited to the amount paid by the user during the last 12 months.

No indirect damages may be claimed.

8. ABUSE / AUTOMATED USE

It is prohibited to:

• use bots or scripts
• extract data in bulk
• bypass limits
• share accounts
• resell results
• scrape the service
• use the service to train AI models

The Seller may suspend an account without notice.

Used tokens will not be restored.

9. SERVICE AVAILABILITY

The Seller may interrupt the service for:

• maintenance
• updates
• fixes
• overload
• technical issues
• security reasons

No compensation shall be due.

The Seller may modify at any time:

• features
• token rules
• pricing
• AI models
• quotas

10. FORCE MAJEURE

The Seller shall not be liable for events beyond its control, including:

• internet outage
• hosting failure
• cyber attack
• natural disaster
• strike
• government action
• war
• power failure
• AI provider failure
• API provider failure

11. PRICES – TAXES – INTERNATIONAL SALES

Prices are in euros unless stated otherwise.

The service is sold from France.

Users are responsible for taxes applicable in their country.

The service is available worldwide.

The Seller does not guarantee compliance with local laws.

12. INTELLECTUAL PROPERTY

All elements of the service are protected, including:

• algorithms
• scoring methods
• databases
• interface
• texts
• analysis results

No ownership is transferred.

Tokens grant no property rights.

13. SUSPENSION / TERMINATION

The Seller may suspend or terminate an account in case of:

• abuse
• fraud
• non-payment
• violation of these Terms

Remaining tokens may be lost.

No compensation shall be due.

14. MODIFICATION OF TERMS

The Seller may modify these Terms at any time.

The applicable version is the one in force at the time of purchase.

15. GOVERNING LAW – JURISDICTION

These Terms are governed by French law.

Any dispute shall fall under the exclusive jurisdiction of French courts.
